Welcome to Splitwisely (the "App"), an application developed by
Dhruv Singh ("we," "us," or "our"), available as a mobile app (Android)
and a web app. By downloading, installing, or using the App, you ("you" or "User") agree
to be bound by these Terms & Conditions ("Terms"). If you do not agree, please do not
use the App.
1. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) to
use the App. By using the App, you represent that you meet this requirement.
2. Account Registration
- You may create an account using an email address and password, through Google Sign-In, or through Apple Sign-In.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- You agree to provide accurate and complete information and to update it as needed.
- We reserve the right to suspend or terminate accounts that violate these Terms.
3. Description of the Service
Splitwisely is an expense-splitting and tracking tool that allows you to:
- Create groups and track shared expenses with friends.
- Record who paid and how expenses are split among participants.
- Manage friend connections, settle balances, and view activity history.
- Track personal (self) expenses for your own budgeting.
- Optionally use AI-powered category suggestions (via Google Gemini).
- Optionally view expenses in different currencies using live exchange rates.
Important: Splitwisely is a record-keeping and coordination tool.
It does not process payments, transfer money, or connect to bank accounts.
All actual payments between users happen outside the App.
4. User Content & Conduct
4.1 Your Content
You retain ownership of any content you create or upload (expense descriptions, notes,
photos, group names, etc.). By using the App, you grant us a limited, non-exclusive license
to store, process, and display your content solely to provide and improve the Service.
4.2 Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable law.
- Impersonate another person or misrepresent your identity.
- Upload malicious content, viruses, or harmful code.
- Attempt to gain unauthorized access to other users' accounts or our systems.
- Abuse, harass, threaten, or intimidate other users.
- Use automated tools to scrape, crawl, or otherwise extract data from the App.
- Circumvent or interfere with the App's security features.
5. Intellectual Property
- The App, including its design, code, graphics, and branding, is owned by Dhruv Singh and protected by applicable intellectual property laws.
- You may not copy, modify, distribute, reverse-engineer, or create derivative works based on the App without our prior written consent.
- "Splitwisely" and associated logos are trademarks of the developer. All other trademarks belong to their respective owners.
6. Third-Party Services
The App integrates with the following third-party services, each governed by their own terms:
- Firebase (Google): Authentication, data storage, push notifications, and remote configuration.
- Google Sign-In: Optional authentication via your Google account.
- Apple Sign-In: Optional authentication via your Apple ID.
- Google Gemini API: Optional AI-powered expense category suggestions.
- ExchangeRate-API: Optional live currency exchange rates.
- Google reCAPTCHA (web only): Bot and abuse protection on the web app. Subject to Google's Privacy Policy and Terms of Service.
We are not responsible for the availability, accuracy, or practices of third-party services.
Your use of these services is subject to their respective terms and privacy policies.
7. Privacy
Your privacy is important to us. Please review our
Privacy Policy, which describes how we collect,
use, and protect your information. By using the App, you also agree to the Privacy Policy.
8. Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis
without warranties of any kind, whether express or implied, including but not limited to
warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.
- AI-generated category suggestions are provided for convenience only and may be inaccurate. You are responsible for verifying and editing expense categories.
- Currency exchange rates are provided for informational purposes only and may not reflect real-time market rates. Do not rely on them for financial decisions.
- We do not guarantee the accuracy of calculations, balances, or settlement amounts. Users should verify records independently.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Dhruv Singh shall not be liable for any
indirect, incidental, special, consequential, or punitive damages, or any loss of profits,
data, or goodwill arising out of or in connection with your use of the App, even if advised
of the possibility of such damages.
In no event shall our total liability exceed the amount you paid us in the twelve (12)
months preceding the claim (if any). Since the App is currently free, this may be zero.
10. Indemnification
You agree to indemnify, defend, and hold harmless Dhruv Singh from and against any claims,
liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of
your use of the App, your violation of these Terms, or your violation of any rights of a
third party.
11. Account Termination
- You may stop using the App at any time and request account deletion by contacting us.
- We may suspend or terminate your access if you violate these Terms, without prior notice.
- Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive (including Sections 8, 9, 10, and 12) will continue to apply.
12. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India,
without regard to conflict of law principles. Any disputes arising under these Terms shall
be resolved through good-faith negotiation first, and if unresolved, submitted to the
exclusive jurisdiction of the courts located in India.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material
changes by posting updated Terms within the App or on our listing page and updating the
"Effective Date" above. Your continued use of the App after changes constitutes acceptance
of the revised Terms.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision
shall be limited or eliminated to the minimum extent necessary, and the remaining
provisions shall remain in full force and effect.
15. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you
and Dhruv Singh regarding the use of the App and supersede all prior agreements and
understandings.
